1.0 OWNERSHIP
CAROLINAS FIRE PAGE (herein referred to as “CFP”) is owned and operated by Jeff Harkey, DBA Carolinas Fire Page, Raleigh, North Carolina.
The internet website (www.carolinasfirepage.com) is owned and operated by CFP.
2.0 DEFINITIONS
The term “Individual Subscriber” or “Individual Member” refers to an individual who pays for CFP services for their own use. Subscribers and Members only use the information received for their personal enjoyment and do not stand to profit from any of the information. They are not allowed to forward any information received to any third party for any reason.
The term “Dispatcher” refers to an official CFP dispatcher who is allowed to dispatch incidents and alerts on the CFP system. Dispatchers are also considered members.
The term “Commercial Client” refers to a commercial business that pays for CFP services and primarily uses the information for their business interests.
CFP maintains a very strict distinction between “Individual Subscribers/Members” and “Commercial Clients.”
The term “CFP Services” refers to electronic alerts, electronic information, the information contained on this web site and other benefits and services afforded to Subscribers/Members and Clients.
The term “Alert” refers to the electronic transmission of incident information to Individual Subscribers/Members and Commercial Clients. (Previously referred to as a “Page”).
The term “Incident” refers to both emergency and non-emergency incidents relating to fire-rescue services and other types of information transmitted on the CFP system.
3.0 COPYRIGHT NOTICE
All information and alerts transmitted over the CFP system are intended for the sole use of our subscribers/membership for non-commercial purposes and may not be forwarded or otherwise re-transmitted by any means, not limited to email, posting on web sites, email lists, via fax or other electronic means without permission. Violation of this policy will result in immediate termination without refund.
All content is protected by international copyright, trademark and other intellectual property laws.
Subscribers/Members submitting information to the CFP system grant CFP the royalty-free right to transmit, publish and otherwise package and distribute the information as CFP sees fit for the purposes of the CFP System.
4.0 EQUIPMENT CHARGES
Subscriber/Member is solely responsible for any and all charges related to their wireless devices, including but not limited to charges for text messaging, messaging services, per alert charges, overcalls, etc.
5.0 PRIVACY POLICY
CFP Subscribers/Members are issued three or four digit identification number for their use. Member names will not be transmitted on the CFP system without permission.
CFP will not share nor sell your personal account information to anyone outside of CFP, with the sole exception of our banking entities as it relates to completing charges for CFP services.
6.0 FEES
CFP is a subscription based service for Subscribers/Members.
Current options for service include:
- A monthly fee of $7.00.
- A six month subscription for $30.00 ($5.00 per month).
- A twelve month subscription for $60.00 ($5.00 per month).
We accept the following credit cards: American Express, Discover Card, Master Card and VISA. If you would like to pay by check (for six or twelve months only please), contact our offices to arrange an invoice.
CFP reserves the right to change fees at any time. Our price structure has been the same since our inception in 1995.
NOTE: Your subscription/membership fees will automatically renew every month (for monthly accounts) or when your subscription is due (for six or twelve month accounts) automatically unless you contact the CFP office and notify us that you wish to discontinue service.
Fees for Commercial Clients are negotiated on an individual basis and are contracted accordingly.
7.0 FRADULENT REPRESENTATION
Any individual or company that intentionally misrepresents themselves or their organization to obtain CFP Services under false pretenses will be held liable and responsible for all information received since the inception of their account.
8.0 REFUND POLICY
Contact the CFP office to discontinue your service. Any unused portion of your subscription will be refunded in the form of a business check.
If you terminate your service within the first thirty days of your subscription, you will receive a full refund.
9.0 CANCELLATION OF COMMERCIAL ACCOUNTS
Monthly Accounts – thirty days written notice required for cancellation of monthly accounts.
Annual Accounts – will automatically renew unless cancelled thirty days prior to annual renewal date. Written notice required.
10.0 CHANGES TO ACCOUNTS
Subscribers/Members may make changes to their account at any time without charge.
11.0 SUBSCRIBER/MEMBER CONDUCT
Subscriber/Member agrees that CFP services will only be used for lawful purposes.
Receiving a CFP Alert is not an endorsement by CFP for any Member/Dispatcher to respond to an incident scene on behalf of CFP.
Subscribers/Members are not allowed to represent themselves as members of the News Media or other organizations using CFP as a credential to gain access to incident scenes.
12.0 WARRANTY/GUARANTEES
CFP makes no warranty or guarantee regarding the accuracy or validity of the information transmitted by CFP.
CFP will put forth every effort to confirm information as much as practical given the constraints of dealing with evolving emergency information.
If an Alert contains erroneous information, efforts will be made to correct the information in future Alerts.
Subscriber/Member warrants that all information provided to CFP for the establishment of services and any incident information provided to CFP is true, accurate and complete.
13.0 LIMITATION OF LIABILITY
Under no circumstances, including, but not limited to negligence shall CFP be held liable for any direct, indirect, incidental, special or consequential damages that result from the use of CFP Services.
14.0 INDEMNIFICATION
Subscribers/Members and Clients agree to indemnify and hold harmless CFP and Jeff Harkey, Dispatchers of CFP, Subscribers/Members of CFP and affiliated third-parties from any and all claims and expenses arising from the use of CFP Services.
Subscribers/Members and Clients acknowledge that CFP is neither responsible nor liable for any illegal, offensive or defamatory conduct of any other Subscriber/Member.
Use of CFP Services is at the risk of the Subscriber/Member and Client.

By subscribing to CFP services, you agree to the Terms of Use set forth in this document.
